  1. The United States federal law does not directly address consensual BDSM sex. However, the legality of BDSM does depend on individual state laws. Although BDSM is consensual, that consent may be problematic in the eyes of the law. BDSM scenes become problematic when they are a bit more intense and aggressive, seeming to blur the lines of consent, and the submissive participant finds themselves experiencing something they did not expect nor want. Sometimes the submissive person can even get injured. In cases like this the dominant person can be prosecuted for assault, sexual assault or sexual abuse. Therefore, one may conclude that BDSM isn’t a criminal act per se, but it has to be completely consensual, regarding both the activities and the intensity. As long as both partners enjoy the play and none of them gets severely injured, the law won’t intervene. You always have the option of signing a contract before engaging into any BDSM activity with a certain partner. This might affect the romance at the beginning, but mutual consideration and respect should come first.
